By accessing any products or services offered by Four Chickens Pty Ltd, which includes visiting this website, signing up for our newsletter or mailing list, or entering any competition run by Four Chickens Pty Ltd on any platform, you, the user, agree to be bound by these terms and conditions. You agree to comply with these terms and conditions, as well as any other relevant policies held by Four Chickens Pty Ltd including, but not limited to, our Privacy Policy. 

It is the responsibility of users to be aware of and comply with our terms and conditions as well as other relevant policies such as our Privacy Policy, Competition Terms and Conditions and User Generated Content (UGC) Terms and Conditions. The current version of our terms and conditions and other policies can be accessed through this website. You agree that you have read and understood these terms and conditions, as well as any other relevant policies. 

You accept all responsibility for the manner in which products or services offered by Four Chickens Pty Ltd are used, and for complying with any relevant laws and/or regulations, both local and international, affecting their use. 

  1. Use licence

All material, content and services offered by Four Chickens Pty Ltd through this website or any other medium remain the property of Four Chickens Pty Ltd. Users are granted a limited licence to use the content and services, including any information or software they are invited to download, for personal purposes only. Unauthorised use is prohibited by law.

Users are prohibited from:

  • Using the materials commercially or in connection with any commercial enterprise

  • Modifying the materials in any way, including, but not limited to, removing from the materials any Four Chickens Pty Ltd branding, copyright etc.

  • Copying or reproducing the materials

  • Passing the materials off as their own or anyone elses’ except Four Chickens Pty Ltd

  • Distributing, sharing or transferring the materials in any form except email forwarding and social sharing where proper attribution is given to Dine a Chook or another registered trading name of Four Chickens Pty Ltd, the material is accessed from its original location and the material is not reproduced or modified from its original form

This use license is conditional and depends upon the user’s acceptance of and compliance with these terms and conditions as well as any other applicable Four Chickens Pty Ltd policies. Four Chickens Pty Ltd reserves the right to terminate this license at any time.

  1. Intellectual property

All material and content offered by Four Chickens Pty Ltd through this website or any other,  plus print media, communications made by Four Chickens Pty Ltd or its representatives and any advertisements hosted by third-parties are subject to, and protected by, copyright law. Materials which are protected include, but are not limited to, ideas and other intellectual property, text, audio, audio-visual materials, graphics, other visual materials, UGC and any other materials created by or for Four Chickens Pty Ltd. 

To the best of our knowledge, we have the right to reproduce this material for any purpose and in any form, altered or no, in perpetuity, throughout the world. No claim is made as to the exclusivity of the material.

All information, ideas and representations communicated by Four Chickens Pty Ltd or any of its representatives, including advertisements, website content, newsletters and personal communications, are made in goodwill with the intention to be useful and truthful. However, Four Chickens Pty Ltd makes no claims and does not guarantee the accuracy, reliability, currency, truth, completeness or any other aspect of the information, ideas and representations made in any communications.

In addition, no claims are made as to the suitability of the content provided to the user (including but not limited to, information taken from other sources). Communications are informative but general in nature. They are not advisory nor are they intended to be a replacement for expect opinions or advice. 

All goods and services are accessed at the user’s own risk. It is the responsibility of the user to determine the applicability of any information, ideas, representations or products (goods) to their own personal circumstances. They are advised to seek further information or advice from expert sources before making any decisions or taking any action.

Four Chickens Pty Ltd takes no responsibility for the interpretation or use of said materials, ideas, information or representations. We do not accept any liability for loss, damages or other consequences resulting from the interpretation or use of any information, ideas, representations or goods offered.

This same disclaimer applies to any third-party platforms used, or links, external information or expert opinions provided. Sharing, referring to, linking to or utilising any of these does not constitute any claim on the part of Four Chickens Pty Ltd as to their safety, reliability, accuracy or suitability for the user. Four Chickens Pty Ltd will not be held liable for any loss or damage, even if due to negligence, resulting from faulty external links, spyware, other malicious software or the actions or omissions of any external site.

  1. Privacy and permissions

All user information is handled in accordance with our Privacy Policy. 

By using or accessing any products or services, you are giving the following permissions:

  1. Your personal information may be collected, stored and used by Four Chickens Pty Ltd

  2. Four Chickens Pty Ltd may contact you in relation to orders placed, other customer service matters, enquiries, notifications, customer research, promotion, marketing, UGC and any other reasonable business purposes 

  3. Your personal information may be shared with any of the parties detailed in our Privacy Policy, including third-party platforms

  4. Non-personally-identifiable data may be collected and used as detailed in our Privacy Policy

When you subscribe to our mailing list, submit a contact form, enter a competition, place an order, whether completed or no, or provide your personal information through another means, you agree that Four Chickens Pty Ltd may contact you by email, mail, phone or social media, directly or through a third-party, regarding our products and services, including, but not limited to, details relating to your order and marketing materials.

  1. Mailing list and newsletter

By subscribing to our mailing list or newsletter, you agree to the following in addition to the other terms and conditions outlined in this document and in our Privacy Policy.

You agree to receive promotional emails from Four Chickens Pty Ltd, trading as Dine a Chook, on an ongoing basis for an indefinite period including but not limited to chicken keeping information, sales and special offers, product details, promotions and company updates. 

Depending on the cookie and privacy settings of your browser or device, your actions on our website/s may be used to provide targeted content including, but not limited to, personalised emails and third-party advertising through Google, social media and other platforms. All personal information of mailing list and newsletter subscribers is handled in accordance with our Privacy Policy.

Should you wish to no longer receive emails, you may unsubscribe from the newsletter or mailing list by clicking the “Unsubscribe’ link included in our communications or by contacting us directly.

Four Chickens Pty Ltd reserves the right to cancel or suspend the subscription of any user at any time, without notice or explanation. We also reserve the right to change or amend these Terms and Conditions at any time, without notice. 

  1. Orders and cancellations

Completing an order constitutes a contract of sale between the customer and Four Chickens Pty Ltd where the customer has:

  • Specified goods to purchase

  • Provided a valid delivery address located (or arranged in-store pick up)

  • Paid in full for the goods requested, shipping and any other applicable fees or taxes

  • Received an order confirmation

When placing an order, the customer warrants that the details provided are accurate and they have the lawful right to use and share these details, including, but not limited to, name, address, phone number and payment details.

Without being held liable for any resulting loss or damages of any kind, Four Chickens Pty Ltd reserves the right to:

  • Request identification, verification of payment or an alternative payment method

  • Restrict the quantity of goods available for purchase

  • Cancel an order or part of an order at any time, including after payment has been processed and order confirmation has been sent to the customer. 

Orders may be cancelled for any reason including, but not limited to: 

  • Errors in customer details

  • Invalid payment

  • Inability to contact the customer by phone or email

  • Errors in pricing, shipping costs or information provided about the goods

  • Our inability to provide the product at the agreed price or in a timely fashion for any reason, such as changing suppliers, unavailability, limited stock etc.

  • Any suspicion of fraud, unlawful conduct or failure to comply with these terms and conditions on the part of the customer

Where an order has been cancelled by Four Chickens Pty Ltd, we will notify the customer as soon as possible by email or phone and provide an opportunity to change the order or receive a full refund of the purchase price including shipping. 

 

Depending on order volume and other factors, orders may be shipped as soon as payment is processed. Therefore, Four Chickens Pty Ltd does not agree to honour any cancellation or change to any order, including change of delivery address. 

In the case of a mistake resulting in the need to cancel or change an order, the customer is advised to call the company as soon as possible. Outside of business hours, the customer should send an email or use the contact form and should then also call at the resumption of business hours. If the order has already been shipped, the customer may be responsible for paying for postage to return the cancelled goods and/or to ship another order.  

  1. Pricing and payment

All prices are in Australian dollars (AUD) and include GST. Shipping costs will be added at checkout except where free shipping is offered on all items in an order. 

For international orders, these prices (in AUD) represent our current, international prices excluding shipping. Special offers on shipping, including free shipping, may not be available for international orders. 

Payment can be made by:

  • PayPal

  • Bank Transfer

  • Credit or debit card

  • AfterPay

All payment and transactions will take place between the customer and Four Chickens Pty Ltd trading as Dine a Chook.

We reserve the right to change prices and product details at any time. 

  1. Shipping

We use a range of shipping agents, including but not limited to: Australia Post, Startrack Express and Australian Air Express. 

Most orders are shipped at 11.30 am the next business day after receiving payment. Service times for delivery may vary depending on the delivery address, the shipping agent used and the time of year. 

Four Chickens Pty Ltd will provide an estimated delivery date on request. Although we will make every effort to provide an accurate estimate, because delivery depends on a range of factors outside of our control, we accept no responsibility should delivery occur outside of the estimated period nor will Four Chickens Pty Ltd be held liable for any loss or damage resulting from inaccurate estimates or any other factor related to delivery.

The customer will receive a tracking number once their order has shipped. If the goods do not arrive as expected, the customer should notify Four Chickens Pty Ltd.

If goods arrive damaged, it is the customer’s responsibility to notify us within 3 days of delivery in order to arrange an exchange or replacement. 

  1. Guarantees and warranties 

We want our customers to be happy and understand if they change their mind. In addition to the rights protected by Australian Consumer Law, we also offer the following satisfaction guarantee:

We will accept returns for a refund or exchange where the customer notifies Four Chickens Pty Ltd of their decision within 3 days of receiving the goods and provides reasons. 

Where a customer makes a return on the basis of satisfaction or change of mind, they will be responsible for return postage. Any freight costs paid by Four Chickens Pty Ltd, which may be greater than the amount initially charged to the customer, will be deducted from their refund.

Dine a Chook also offers the following warranties:

  • Dine a Chook Feeders and Drinkers: 3 year warranty 

  • Lubing Cups: 12 month warranty

  • All other Lubing components: 12 month warranty

These warranties cover defects (parts or materials) and damage sustained through standard daily use as per the product instructions. They do not cover damage resulting from human/animal action or inaction, nor acts of God. Warranties do not cover damage resulting from failing to correctly maintain the product or from using the product in a manner not intended or recommended by the manufacturer.

In order to activate any product warranty, the customer must:

  • Make any claims within 2 weeks of the defect/damage becoming apparent.

  • Notify Four Chickens Pty Ltd of the nature of the defect or damage, providing photographs if requested.

  • Provide Four Chickens Pty Ltd with a valid proof of purchase demonstrating that the product is still within warranty.

  • Negotiate with Four Chickens Pty Ltd to rectify the problem. The customer may be offered a replacement, repair, refund or store credit, depending on the nature of the problem. 

  • Follow the returns procedure outlined below if a return of the faulty product is requested.

Guarantees and warranties will only be honoured where the customer meets the conditions outlined in these terms and conditions.

A 10 year manufacturers warranty is offered on all bird netting. This warranty is against damage caused by UV degradation and does not cover any other wear or damage.

  1. Returns and refunds

Returns will be accepted where:

  • We have sent the wrong item

  • An order arrives damaged

  • The customer has a right to a return protected by Australian Consumer Law

  • The customer has changed their mind and notifies Four Chickens Pty Ltd within 3 days of receiving the order

  • We are otherwise at fault

Customers may be offered a refund, store-credit or exchange, at the discretion of Four Chickens Pty Ltd and in compliance with Australian Consumer Law. Refunds can only be provided by the same manner in which the original purchase was made, for example to the customer’s original credit card or bank account.

Customers seeking a return or refund, regardless of whether Four Chickens Pty Ltd is at fault, must meet the following conditions. Where they do not, they waive any right to a return or refund except those protected by Australian Consumer Law.

  • Four Chickens Pty Ltd is notified by the customer of the return request as soon as possible after receiving the order and no later than 3 days after receiving the order (this includes for erroneous orders or damaged goods).

  • The customer provides Four Chickens Pty Ltd with a valid proof of purchase, if requested.

  • Four Chickens Pty Ltd grants approval for the return by phone or email, or otherwise rectifies the problem in a manner agreed by the customer (e.g. by sending a missing item, replacing a damaged item etc.).

  • The customer returns the item via registered and insured post. The customer must also send the tracking number to Four Chickens Pty Ltd. We will not honour returns that are lost or damaged in transit unless they have been sent via registered and insured post.

  • On receipt of the return, Four Chickens Pty Ltd will provide an exchange, store-credit or refund as previously agreed with the customer and in compliance with Australian Consumer Law.

Where we are at fault, the customer may be refunded or given store-credit for return-postage paid or for postage paid to ship additional goods. However, the refund of postage is not guaranteed and will be decided at our discretion on a case-by-case basis. 

In the case of ‘change of mind’, the customer will be refunded their payment minus all freight charges incurred by Four Chickens Pty Ltd. Where we have subsidised freight charges (most commonly deliveries of bulky items or deliveries to rural/international areas), the entire freight charge, which may be greater than the amount paid by the customer at purchase, will be deducted from the refund.

  1. International orders

International orders must be made by persons located outside of Australia and shipped to an address located outside of Australia. 

All prices on the website are in Australian dollars (AUD) and represent our current international pricing. International customers should note that not all products can be shipped to all destinations and special offers on shipping, including free shipping, may not be available for international orders. 

For international orders, bank transfer and PayPal are the preferred methods of payment. Credit and debit card payments will only be accepted from customers enrolled in Verified by Visa or Mastercard Secure Code. All payment and transactions will take place between the customer and Four Chickens Pty Ltd trading as Dine a Chook.

It is the customer’s responsibility to be aware of all relevant taxes and restrictions. Four Chickens Pty Ltd cannot advise international customers about taxes or restrictions in their country.

Where foreign governments impose a customs levy, duty or other tax on international deliveries, the customer takes responsibility for all payment as well as compliance with any relevant local laws or regulations regarding the import/export of goods and/or the legality of the products purchased in the country of delivery. 

  1. Liability

Four Chickens Pty Ltd, including its owners, employees and representatives, is not responsible for and excludes any and all liability (including negligence) for any loss, damage or expense (whether direct, indirect, special or consequential) resulting from:

  1. Any errors, omissions or inaccuracies contained in the information provided, nor any loss or damage resulting from them

  2. The use or function of products and services, including information communicated, whether said information is accurate or no

  3. Technical difficulties, equipment malfunction, or any viruses, defects, errors, worms, malware, harmful or faulty code, either in the content, in attached files, electronic communications, faulty links, software, applications, third-party platforms, external links or downloads, whether or not resulting from the negligence of Four Chickens Pty Ltd or its representatives

  4. Third-party interference with the website or with Four Chickens Pty Ltd communications

  5. Any actions or behaviours of customers or website or communication users, whether based on information communicated by Four Chickens Pty Ltd or no

  6. The use of our products or services in any manner, including, but not limited to, unlawful use or use that may cause loss or damage in any way whether recommended by Four Chickens Pty Ltd in some way or no

 

  1. Alterations and amendments

Four Chickens Pty Ltd reserves the right to alter these terms and conditions, as well as any other relevant policies, at any time in any way permitted by law. Alterations and amendments will be effective from the time of their publication by Four Chickens Pty Ltd on this website or through any other appropriate means.

    1. Products or services: Any and all products or services offered by Four Chickens Pty Ltd in the course of conducting business, whether provided by the company or by an external entity on our behalf. Products and services include, but are not limited to: this website; any other website owned, operated or used by Four Chickens Pty Ltd (e.g. the Dine a Chook blog, Dine a Chook social media); any scripts or applications that operate as part of these websites including those belonging to third-party platforms (e.g. shopping cart, Paypal, chat-bot, contact form); any content made available through the website, blog, mailing list, download, in print or any other medium; any contact between Four Chickens Pty Ltd or its representatives and any user; any competition run by Four Chickens Pty Ltd, one of its agents or partners, on any platform; and chicken feeders, drinkers, bird netting, poultry healthcare products and other goods available for purchase.

    2. Four Chickens Pty Ltd (we, our, the company): The company, including any of its employees, agents or representatives, trading under the name of Dine a Chook or any other name or trademark.

    3. User: Any user of the products or services offered by Four Chickens Pty Ltd, whether or not they have made a purchase or contacted the company directly. For the purpose of these terms and conditions, a user may be a mailing list subscriber, a competition entrant or any visitor, transient or otherwise, to this website or any other website owned, operated or used by Four Chickens Pty Ltd or any other person who makes contact with Four Chickens Pty Ltd through any other means.

    4. Social sharing: Sharing materials in a purely social, non-commercial fashion with appropriate attribution. Social sharing includes, but is not limited to, sharing a link through email, social media, a blog or other website or forwarding an email or newsletter. In all cases, proper attribution must be given, the material must be accessed from its original location and it must not be reproduced or modified from its original form.

    5. Third-party platforms: Third-party platforms include but are not limited to, website hosts, technical support providers, applications such as chat-bot and Paypal, social media platforms, databases and email marketing services. 

    6. Customer: Any user who enters into an agreement to purchase a product by completing an order through the website, on the phone or in person.

    7. Completing an order: Placing an order by submitting a list of products to purchase, making a valid payment and providing a valid delivery address.

    8. International orders: All orders made by persons outside of Australia and to be shipped to an address located outside of Australia.

    9. Notifies: Contacts by email, phone, in person or by mail.
